In late January 2023, The Day Before suffered a delay due to a supposed trademark dispute. The game was removed from Steam due to said trademark dispute, though Fntastic, the game's developer, initially said that it was removed due to a "technical difficulty" with the regular Steam maintenance. As we learned, that was a lie.

The trademark woes were then revealed on Twitter. It seems as though Fntastic did not own the trademark for "The Day Before" and have had to deal with those issues. That also raised other questions about why nobody working on the game looked into the trademark since the game was revealed some two years ago. This all comes after the game was postponed initially due to an engine switch from Unreal Engine 4 to Unreal Engine 5. All of this resulted in The Day Before going from a June 2022 release window, to March 1, 2023, to now being scheduled to release on November 10, 2023.

In speaking with IGN last month, Fntastic said that they had totally "planned to move the game's release before" the issues with the trademark were brought into the limelight. The studio also pushed back against the claims from many that The Day Before is nothing more than a scam. They say, "the storm will calm down eventually, and time will put everything in its place. When the game comes out, people will finally see the truth."

Despite the red flags surrounding both the studio and this game, Fntastic pushed out a new 10-minute long gameplay trailer today. This is the first look at The Day Before in over a year.
