Valve is being sued yet again. This time it's from New York's attorney general Letitia James. According to reporting on this lawsuit from Reuters, James is accusing Valve of "promoting illegal gambling and threatening to addict children through its use of 'loot boxes'."
The suit was filed earlier in the day on February 25 in a state court in Manhattan. James says that the loot boxes violate the New York state constitution and penal law, due to them often having hard to win high-value items and many items that are worth next to nothing.
James continues on to say that the loot boxes from Valve amount to "quintessential gambling." She continues, "Valve's loot boxes are particularly pernicious because they are popular among children and adolescents." She says that Valve has generated billions of dollars in revenues by selling virtual keys to open the loot boxes. Continuing on, she notes that key sales helped boost Valve's business in addition to letting players sell items they obtained from these loot boxes through the Steam Community Market and through other marketplaces.
Children introduced to gambling by age 12 are four times more likely to become problem gamblers as adults, the complaint added, citing the Massachusetts Department of Public Health.



Now in this case, I'm asking for a lawyer to determine if the ToS is what a reasonable company would also employ, and if the inability to withdraw by design is enough care to prevent obvious abuse, which would certainly hurt their case to punish VALVe. It's important for me to state the possibility, rather than assuming VALVe can be sued anytime. But watching Coffeezilla's videos made me honestly believe it's worth it for lawyers to try to analyze and see if there's enough potential to do legal action to further send a message against unregulated gambling. Because ultimately, the abuse and exploit has absolutely turned these games into unregulated gambling since the law is too outdated to prevent things like gambling for minors.
Plus if it gets regulated by the government, then that's a good potential source of revenue for the government spending budget.
