Gearbox has filed a lawsuit against 3D Realms and Interceptor Entertainment over unauthorized use of the Duke Nukem IP. Gearbox picked up the rights to the Duke Nukem IP when 3D Realms sold it back in 2010. Allegedly, 3D Realms was quietly talking with developers and trying to make it seem like they never actually sold the IP.
Ha ha, whoops!
So that Duke Nukem: Mass Destruction top-down action-RPG that surfaced a short while ago really isn't legally allowed...
