Gearbox claims 3D Realms is in breach of contract.

Gearbox is headed back to the courtroom, though they may have never actually left. This time, they're the ones doing the suing. The development studio is suing Apogee Software, the parent company of 3D Realms, over a breach of contract in its acquisition of the Duke Nukem franchise and IP.

Gearbox Software announced yesterday that the lawsuits between them and 3D Realms over the Duke Nukem IP have been settled. Statements were conveyed to the public from 3D Realms, Interceptor Entertainment, Gearbox, and Frederik Schreiber.

In response to the lawsuit made against the company by Gearbox Software, 3D Realms claims that it still has the right to complete and sell a game called Duke Nukem Survivor.

Duke Nukem Survivor is apparently the Duke Nukem: Mass Destruction game that's been mentioned recently.

In addition, 3D Realms claims that Gearbox doesn't even own the trademark to "Duke Nukem" anyway. They claim it was never part of the Asset Purchase Agreement for Duke Nukem Forever. And so ...

Gearbox has filed a lawsuit against 3D Realms and Interceptor Entertainment over unauthorized use of the Duke Nukem IP. Gearbox picked up the rights to the Duke Nukem IP when 3D Realms sold it back in 2010. Allegedly, 3D Realms was quietly talking with developers and trying to make it seem like they never actually sold the IP.
