    3D Realms Issues Statement - Offered "Unacceptable" Last-Minute Proposal from T2

    3D Realms has issued a lengthy statement about the status of the company and of the Take-Two lawsuit. The company asserts that it was only given $2.5 million from Take-Two and this was back in July of 2008. This sum was actually for a non-Duke Nukem Forever agreement made for an another, undisclosed title.

    3D Realms was largely self-funding, providing nearly $20 million in funding for the title over the years. Aside from the $2.5 million provided last year, $400,000 was given by GT Interactive as a signing bonus back in 1998.

    Discussions with Take-Two began late last year to continue funding for Duke Nukem Forever. While this was going on, the team at 3D Realms was consistantly hitting milestones that were agreed to previously with Take-Two.

    Take-Two and 3D Realms were in talks in the months leading up to the demise of 3D Realms. Take-Two offered to purchase the Duke IP and take on the 3D Realms team but the offer was declined.
    Take-Two's proposal was unacceptable to 3DR for many reasons, including no upfront money, no guarantee minimum payment, and no guarantee to complete the DNF game. From 3DR's perspective, we viewed Take-Two as trying to acquire the Duke Nukem franchise in a "fire sale." Those negotiations fell through on May 4th, a deal never materialized, and the DNF team was sadly released a few days later.

    As it stands, 3D Realms is still operational but just barely. The company still owns the rights to the Duke IP and the rights to sell the game directly to the public if it was to be finished. Take-Two still owns the publishing rights to the game.

    The sad thing is that the legal maneuvering WON'T take as long as the development of DNF.

      Does this mean 3DR will eventually (not for DNF in this case) switch publishers to EA and ditch T2 just like VALVe did to VU? Developers and publishers can't seem to get along it seems.
