This past July, a number of Linux users who were using WINE to play Diablo 3 were reporting that they were wrongfully banned from Battle.net simply because they were using Linux. At the time Blizzard responded to support tickets claiming that there were no wrongful bans issued and that those users were banned for legitimate reasons.
It turns out that this was not the case for all of those bans dished out.
A user known only by the handle "vexorian" was running some tests to see if it was a bug in Wine 1.5.13 and 1.5.14 that resulted in these bans from Blizzard. Sure enough, vexorian was banned on October 23 due to an issue with Warden, a client used by Blizzard to ensure that no third-party software was being used in conjunction with their games for malicious purposes.
Vexorian then purchased a second copy and played it on Windows XP. A short time later on November 14, Blizzard tech support issued the following email to him.
Vexorian was given back his previously banned Diablo 3 license and was also issued a refund for the second copy he purchased. Compare that recent statement to one issued by Bashiok from a few months ago.
Linux users who feel they were unjustly banned may want to look into this matter to see if your license for Diablo 3 can be unbanned now.

However, we’ve found evidence that the closure may have been a mistake on our part so we will re-open the license for play as soon as possible. We humbly regret the error and hope that you will accept our sincere apologies.

We’ve extensively tested for false positive situations, including replicating system setups for those who have posted claiming they were banned unfairly. We’ve not found any situations that could produce a false positive, have found that the circumstances for which they were banned were clear and accurate, and we are extremely confident in our findings.
