Namco Bandai has won a hard fought battle for the publishing rights to the Xbox 360 version of The Witcher 2 from CD Projeckt.
Back in July, Namco Bandai targeted CD Projeckt's parent company, Optimus SA, stating that they had secured the rights to publish the Xbox 360 version of the game in western Europe, Asia-Pacific, Central America, and South America. This claim was made prior to the developer announcing that the title would be published by THQ in these regions instead. Well, the court decided that Namco Bandai are the legal winners here and thus THQ is out and Namco Bandai is in as the publisher in those regions.
The ruling states that CD Projekt must give Namco Bandai an agreement within a period of 15 days, of they face a fine of 15,000 Euros per day for each day it fails to provide an agreement.
The reason for the delay in the release of the console version of The Witcher 2 is largely the result of this legal battle. CD Projeckt is, understandably, not happy with the verdict.
