Microsoft Sues DHL After Train Derails, Damages Xbox 360's

Microsoft is suing DHL Express after a train carrying 21,600 Xbox consoles derailed in Texas. Two containers of systems suffered "impact damage, wetting, pilfering and shortage" as the train made its way from McAllen, Texas to Long Beach, California.

The ultimate destination of these units was to be Flextronics Industrial located in Hong Kong. DHL has refused to compensate Microsoft for the loss and has subsequently been sued by Microsoft for "negligently breached its duties as a common carrier, handler, bailee, warehouseman, agent, or in other capabilities." This is according to court papers recently filed.

The lawsuit finds Microsoft seeking over $2 million in damages from DHL. The train accident occurred on October 13.
