Against the TOS? You have got to be kidding? As though that would stop any server from enforcing any of their own specific rules. I played on a server last night that would kick/ban if the defenders lingered in the attacking team's AO after the defenders lost their Mcomms.

you can not restrict a players game play, I have yet to see it happen in BC2 but I saw it plenty of times in BF2 and 2142. people who try to restrict a players game play can have their server privileges revoked, it just takes a few pissed off people reporting the server for violations directly to EA and they will quickly remedy the situation. it falls in the same category as a knife only server.

It's a perfectly viable tactic, especially for taking out a Mcom station when the rest of your lousy team is in the corner of the map sniping, especially since they adjusted the amount of explosives needed to destroy a mcom, your still going to have to make atleast 2 runs at it and a alert enemy will shoot you off the 4 wheeler every-time.

You can legally ban jihad on a ranked server. I've never seen a BF2/2142 server get shut down because of banning jihad. It's not the same as running a knife only server, don't be ridiculous.

It mentions nothing about jihad tactics, in fact, right from that thread.
"Server Administrators are in violation of the EA Online Terms and Conditions if they enforce server rules on ranked servers that prohibit or severely limit players from using any roles, kits, weapons, vehicles, or other features of the game while playing on their server"
jihad attacks are a feature of the game, they have been since BF42.

However, server administrators are allowed to enforce rules, as it explains here:
The important part to be aware of is that the rules allowed only result in minor changes to gameplay behaviour or styles and that these rules introduce minor or limited restriction on certain aspect of the game. What this means is that servers that disallow the entry into or the attack of the uncaps (called Deployment Zones in BC2) are in accordance with the RoC. Similiarly, the following rules would also be in accordance with the RoC:
No C4 on M-Coms - This does not completely ban the use of C4 nor does it ban the destruction of the M-Com through alternative methods to arming. Therefore, this represents a minor restriction on how a certain aspect of the game (C4) can be used.
No Stealing Vehicles from Uncaps - Much like above, this does not ban the use of vehicles completely but is a minor change to gameplay behaviour.
No Spawncamping - Self explanatory really, you're not allowed to camp on an enemy spawn and kill the enemy as they spawn in, this is a minor change to gameplay behaviour.
No Jihad [Jeeps/Quads/Vehicles] - This rule is a legacy rule from past Battlefield games. It was often phrased as "No Jihad Jeeps". A Jihad in Battlefield is when you rig a vehicle, such as a quad or a humvee for example, with explosives and use it as an IED.
No Kamikaze - This means that you are not allowed to deliberately use suicide tactics to kill an opponent or damage an objective (for example, dropping C4 at your feet and detonating it, killing yourself and your opponent, when in close quarters combat.)

It's not like Jihad jeeping is op, even with their mediocre netcode.
No stealing vehicles from uncaps and spawncamping... Lololol, time Dice had some little things from mods like locked vehicles (100% locked or locked before your team use it) and deserter zone for the enemies in all uncap main bases. But no, I guess we'll keep these arbitrary rules until BF15.
As for kamikaze I do agree it's annoying when someone crash his plane into your chopper/tank just for fun, but sometimes you can kamikaze for your team especially when you see a juicy target. If I throw C4 on a Bradley but the enemy inf spotted me and is firing on me, I won't wait until I'm far from my C4 to detonate it. Just add some negative poitns for suicide, that way you can still rack points after death, and it also prevent Gustaver from firing upclose and killing both of you when you melee them.
