    Actually I agree with the previous poster. This is a bad analogy. (Is that spelt right). Providing a service, even a free one, has responsibilities, especially the health and welfare of the people.

    Subsequently, say your always filthy and smelly and vulgar but want to use the facilities, then the providers have a right to refuse you because of the welfare of the others. Likewise, turn up wel fed and immaculate in a 3 piece suit with groomed hair and manicured fingernails I am sure you would also be refused service. Why? Think about it.

    So if your "leet" and "pwning" and the service provider decides your just too good and the server and the other regular players are suffering because of your presence then he has every right and make that difficult decision to remove you if he wants to.

    Take a look at N@M server on BF2142. Kain is on there 24/7 and always takes commander. He sits in the forward aa gun on the titan and stays there but makes no effort to command at all. If that was another owners server wouldn't you ban him to stop him doing it?

    There are two sides to every story and we only see one side in this argument. I wonder what internode would say. Is there an official internode forum... perhaps there is a thread about this situation discussed on there?

      Additionally, if you want to prove anything like defamation, you need to prove intentional malice.

      That means, Internode as a company wants to make you personally look bad. I highly doubt that was some corporate bigshot with the authority to dictate policy banning you from the server.

      Additionally, what are your damages here? What monetary loss have you incurred? If you are still able to fire up BF2 and connect to a server, any server, you have not incurred a loss. Have you lost a job from being banned from BF2? Other lost income in some way? If not, you have no standing with the court and they will not even hear your case. Going through the legal process is much more complicated and involved than you think it is or than TV shows make it out to be.


      Even if you can prove that said defamation was deletarious to your character and well being, what was the extent of the damage imposed by Internode? From what I can ascertain, only a handful of people would know that you had been banned, at least before you told everyone yourself. That is a self-inflicted injury, and like before, has no bearing in a court of law.

      Also, regarding the costs, you're also looking at court fees and other varied and assorted costs. Certainly not worth the effort or the expenditure.


      I'll provide a slightly better analogy than the one provided above. Take, for example, if we banned a user for being combative with the staff by not letting locked threads drop. You are being denied access to a service, but you have no loss from not being able to access this site. Were you some sort of subscriber for some premium account or whatnot, then we may have an issue (and have to refund the remaining balance of the subscription or something to that effect).

        The biggest issue is EA being a complete failure in regulating their "official ranked" servers. They do nothing to adequately monitor the servers and rarely take action against server owners or lessees.

            thanks for the debate and support guys without flaming me:)

            I agree signa :salute:,and i didnt like the idea of ranks when it was first born because in the old days u left playing feeling like a champ :yay:.But now.. ranks bring hacks,more exploiters than normal,ppl sharing accounts or 24/7 players and problems like this thread.

            Maybe you should close this thread Alex?before it gets too much flamage:p
            But il leave that up to you if its good debate or not:salute:

            The AA in bf2 is poobar anyway and hence the game is all air now.I really hope the new bf2 has better AA or Anti-Air that actually works.

            I guess il wait for bf3 and hope that is not one team kill ban either!

              Appeal on forums. If they are retards just change servers. Don't know about Australia but there are many good and well admined servers in EU

                The one complaint most people, and rightly so have is that EA should police their servers and the server admins more.

                I had a rare oppurtunity in that I was the senior admin for 6 servers on behalf of a magnaminous unreal gentleman who paid for them because he could!

                To me it was a goal to make them the best in the world and that meant I wasn't watching out for myself or even the other admins but was watching out for the bigger picture. The servers needed to attract constant regular players who were legitimate and not a bain on the reputation of the server.

                I was occasionaly ...caught out with my flies undone ...because certain admins I played alongside made the hairs on the back of my kneck stand up and I said so in the server admins only chat forum sections but there ya go. (Which is why I don't admin anymore lol.)

                Moral of story... Play on servers that do not answer to one person (clan leader? etc) I play mostly Gotland university servers these days. They don't have one person who dominates. They have lots of admins that work to a common interest. Also they rarely group up on one side to overhelm the foe. That really sucks on clan servers.

                  Well as senior BF admin for Games On Net (Internode) I think I should just clarify some things. What ppl say on public forums is in most cases nothing like the actual events that took place.

                  First off, we always tell a player why their cd key has been banned and for how long the ban will last, this information is provided to all players when they follow the ban appeal procedures and submit an appeal.

                  Your permanent ban was for racism. Racism is regraded as a very serious offence on our servers and will see you permanently banned without warning. Your TKing ban was for blatantly killing a team mate who got the jet before you did (This player made the effort to report you, so we took action).

                  These bans came about because you were reported by your fellow gamers who felt you were annoying enough they would take their own time to report you. Because it was your 1st offence on a new cd key the ban imposed was for 2 weeks.

                  We have strict guidlines in place that are very time consuming when processing 'trouble maker reports'. We review the demo and chat logs for every report we get before placing any ban! There are not too many BF servers that put in the effort to do these reviews and as a result we provide a gaming environment where tards are a minority and most players have an enjoyable gaming experience.

                  We are a privately run network (one of the largest in Australia) but we have to answer to the senior network admins, playing on these servers is a privelege, not a right. We dont go around banning ppl without just cause or reason. You broke the rules, you do the time.

                  For every banned player crying sour grapes on 3rd party forums about their ban, there are probably 200 players that appreciate the time we put in to remove these tards from the servers.

                  If you dont like the way we do things then we have process you can follow to submit your complaint to the network admins, or, you can find another server to play on.

                          Why not start your own server. If there server is so bad, then people will obviously want to play on yours.

                            Yeah then instead of teamkilling for jets he will just kick people out of his server and make sure to include a racist word in the kick/ban reason.

                              ok for the record ..

                              the racism is something i should not have said but that person or clan i abused was hacking and exploiting our main big time and raping the base and spawner positions with claymores(it was our only flag and i wish i left it before i got angry now)

                              the second was a guy abusing me for being commander and he was shooting all our own stuff except HIS jet,he was not helping team play and he Tk`d me first!

                              just so u look at the full picture and not one you have made from just looking at me.
