The EULA does not entitle EA to break laws. Regardless of what the EULA says and I have read it.

The EULA says that EA only liscences teh software to you and you do not own it so does that mean they are allowed to come and break your door down to get it back?

So far I have seen comments from kids just out of their teens and they are always the same. YOUNG ADULTS that know everything lmao.

It would also be good to hear from anyone who has ever studied law or even knows a bit about law. Maybe then we could have a proper debate about legailities rather than just attacks by TROLLS & FLAMERS

Okay, let me get this straight, you're upset about your clanmate being wiped for having a score of 300. okay, fair enough.

But the way you go about it is to bring down anyone else with a score of 300+ and that to me is completely hypocritical. Youre frustrated about it, rightly so perhaps. But you want everyone else to feel the same way?? You really confuse me there...

And okay, so you're 35. Im a 40 year old billionaire with blonde buxom babes hanging off my arms... i dont care. I never said *you* were immature, nor did i say he was. I simply said that the way your clan is dealing with it *IS*coming off as immature and spiteful.

You have missed my point. Its not about the account its about having ones character mared and a criminal offence made against that person.

Defamation of character IS a criminal offence and this is a case of defamation of character. Its an attack on his identification. Ok so its an online name but its a NAME..when you were born you were givin a name by your parents...When you are born into cyberspace you create a Name and Identification as well.

His Identification has been attacked and he has lost respect because of this.

All those who flame me...one has said he is a kid that has been caught.. Well then all those with 300+ have nothign to worry about do you.

If you came onto my server and I banned you just because you shot me 10 times in a round would you complain. How about if I mades posts on here that you were a cheater when on my server and you got banned from all servers. Would you complain? Would you try and get it overturned and clear your name?

          Think about it.

IndianScout.... dont quote facts at people which will prove them wrong, especially from an EULA....

we know *everybody* reads them and so *nobody* needs reminding

If your friend got that +300 points in mashtuur before the Bh-nerf then they sould consider that round totally legitimate.

Therefore your friend should contact EA and demostrate them it was legit to own those points that way.

As far as I know EA does not give the reason for resetting a player other than they have abused the scoring system. How does anyone know if it really is because he had a score over 300 and that he may have gotten reset for another reason.

Well in my mind I see it as direct action. 1 Person will change nothing. A 1000 will open eyes.

If I came here and said. "Ok he had his stats reset just because of having a score of 300+" who would care. You would all say get over it. Well im pointing out that there IS legalities involved which will open peoples eyes who have had it done to them. I do not like large companies who abuse people thinking they can get away with it.

Microsoft did it by blocking web browsers working on their operating system and rightly so they got sued for it.

Well I am saying here...fine EA has a right to change stats as was pointed out in the EULA BUT if they have a reason because of the system then fine.. But to pick on an idividual that ATTACKS the character of that person and labels them a cheat is not on. If he had cheated fine. But he is innocent and should EA be allowed to pick on people this way? To attack people based on what THEY WANT?

Well we have been in contact with EA. They will not give actual reason but it was strongly suggested that it was because a best round score of 300+ is not what they class as possible.

In theory I would think it could be labelled as libel but in practise I really don't think you'd get anywhere by trying it, there'd probably be a million reasons why it would be pointless.

However, I still don't think it's very fair IF there are totally legit ways to get 300+ in a round. If you have a look at the top 20 or so players, 5 or 6 of them have scored 300+ in a round, so I would expect them to get wiped pretty soon. A lot of the time I reckon it'd be hard for EA to spot cheaters or padders but if they're running this as a global rule it'd be very simple to find those players who have scored 300+ in a single round and wipe them. Why your friend and not all the others?

                      I suppose the questions are..

                      1) Is it possible to get 300+ in a round without padding / etc on legit ranked servers?

                      2) Are you sure this is the reason the stats were wiped?

                        Thats a good point

Rancid_Elf, you said before that there is no screens of him cheating, how do you know? who is to say that he wasnt caught on a screenshot of a k/p server's scoreboard or something? Theres plenty of people who dont consider that to be cheating, cheating being the crux of your argument.

But again, when it comes to the defamation of character thing.. its an online character with little to no relevence in the Real World. to try legal proceedings over this would certainly get you a lot of publicity - news programs would run the story at the end after the weather, as one of those "we'll leave you with a funny story" stories.

The entire point that is trying to be made here is that, the specific player whos stats were reset did not deserve it, also when people attempted to contact EA over the resetting of stats they gave no reason. Perhaps BFROE has a record of Ice, and the reason for his reset. I know you guys don't actually "wipe" the stats, but people report "abuse" to you, so you may have a record. Also, rancid and the clan is frustrated by the unwillingness of EA to say almost anything in regards to the reset, don't take everything personaly guys, understand that if this happend to you or a friend of yours you would be frustrated to.

You are right in many aspects. I know even trying to take a case like that to court would be hard...BUT it will come to it and it would be ground breaking.

Cyberspace is getting to the stage where it will be policed etc...take the guy who went to the police over some artifact he got in a game..not sure what it was or what game but he lent it to someone to use or something and they sold it on ebay lol.

not sure the result but things are heading in that direction.

ok ok I would never send peoples ID's into EA I am not like that. I wanted to get as many people to think about this as possible. I am pretty sure it was reset because of the 300+ there is nothing else in his stats that would stood out. I wanted to get feeling from people if they thought they would get stats reset because of being over 300+.

And as for the mention of him being on a KP server that would never happen. I know this guy and he is cleaner than clean.

One thing that did strike us though was that this happened a week after we had to boot 3 members from our clan. It has crossed our minds that one of them might have sent his ID into ea and said something.

But again EA to be able to reset stats based on a few figures is not right...ESPECIALLY after they reset firestorm's because of the commander glitch. He turned and said...o you cant prove if I used it or it happened form a bug so they put his stats back/...WHY because he is top or did he make some claims against them for attacks etc...who will know

each player report is verified no less then 4 times before being sent in, so the likelyhood of someone falling thru the cracks is remote

In regards to question 1, yes it is very possible.
Example: Playing on a 32 man server with 15 people can make the round endless, if someone is either chopper whoring or tank whoring 250+ is easily atainable. And lets not even go into commander points. This happend just last night on a server i was playing on. Most of the people on the server were low ranks and rather bad tacticians so it was just a flag hop game and it went on for a good hour.

Does BFROE have copies of those verifications, i know you can't show them but it would be interesting to know if they exist, also do those verifications include reasons for reset?
