I can't tell what Valves cross motion was in the 2nd order without seeing the paper submitted, but they failed on that one.



It says in the 3rd order that the damages Valve can claim cannot include "special, incidental, consequential or punitive damages of any nature". But if it is decided at trial that Sierra/Vivendi were acting in "bad faith", then that limitation may not be applicable.



So if Valve can prove Vivendi acted in "bad faith" then its "ch ching, I'm going to buy an island" time for Gabe.
