        If you were really serious about protecting your copyright, you'd sue the game, not just take down a video of it. This just seems like an act of frustration, there's no real point in getting the video taken down.

            the stinger didn't take out the ac-130 though, it looked as if ac was deploying flares to counter it... great, as if airpower wasn't powerful enough already, now they have anti-aa.

              YouTube is required by law to remove any video that has been served with a takedown request, whether the request is sound in law or not. The person who put up the video, in this case Infinity Ward, must then serve a counterclaim stating that they do in fact own the copyright to the content in question, which they most likely do. In that case, the video would be put back up, and the legal machinations of the copyright system would churn.

                Probably too late for that. Burning bridges he has I would think. The Twitter DM from 402 kind of said it all on how bogus he was for such an action. It wasn't an official comment from IW, but 402 is our only connection to the devs pretty much and most people would like to think Joker is the PC community's VIP voice.

                As for copyright infringement, in the EULA it clearly states in plain English that any derivative work is property of Activision and can even be sold/used.
                Not to mention, AC130 is in the singleplayer campaign, and there is code for the MP version in the mod tools. There was also a Nuke in the singleplayer campaign.


                I think TheMystic said it best over at Valve forum:
                "PSTJoker is just a modder without any rights. The second someone starts modding in another party's engine all rights are lost to any and all content created period, unless otherwise stated.

                If a modder ever wants to retain any sort of rights for their own rights for unique ideas, he/she MUST be using an in-house developed engine, or a properly licensed third party engine. Even then rights on something as generic as a nuke really do not apply. You can not be the only game with a nuke, otherwise there would have been legal battles for years over it already.

                Joker's AC130 was implimented using assets from the single player campaign of MW, such as the UI, all within Infinity Ward's engine. He has NO rights, the only entity that could ever try to file a copyright takedown request over an AC-130 based MW2 video would be Lockheed or Boeing, and I'm pretty damn sure IW received permission prior to using the AC-130 in even the first MW.

                What Joker did was completely uncalled for and irresponsible, not to mention illegal. He is a complete fool if he actually believed that he had any sort of right to file such a claim, as is anyone that supports him. Additionally, it is he who is using terms like AC-130 without permission on his own videos, and he should be the one subject to takedown requests by Lockheed, and Boeing. Infinity Ward also has every right to demand that his modding efforts cease, and that his Youtube channel be taken down for displaying their works

                      I for one support Jokers... "joke". As a modder, he knew very well that he didnt have a legal leg to stand on. Its very well possible that he knew the procedures for copyrighted video materials on Youtube. People are talking about burning bridges without remembering who torched them first.

                      Honestly, I laughed when I read this news. 402-s response was priceless.

                        Actually, he took IW's assets and reworked then with a new idea, AC130/Nuke that IW then used in MW2.

                            Im surprised youtube took it down and all power too you Joker ive loved every single one of the Extreme mods and frankly im not surprised that ideas for mods the community created have been taken as they are great ideas. I agree that despite what the EULA says it would be common courtesy to include some form of recognition that this is where the ideas came from I mean its not like it was just the AC 130 thats been included in it there is also things like the Nuke which was in Extreme and also the "winning kill" kill cam is in the Breaking Point cod2 mod and no doubt countless others so its not just a single idea thats been lifted.

                            You of all people aswell sparks should recognise the importance that the modding community can play a part in due to you coming from that very community and due to this I believe you were even given a testing position on World at War (Hopefully I am talking about the correct sparks lol). However is this very incident not detracting from the idea of modding and customising the game when IW can just lift your idea and chuck it in their next game without so much as a "how do you do". If you look in the credits in most of the current mods that are out there you can see the throwbacks to the orgins of this community's modding group such as Bell and the HoB crew. These people may have left but they could pop onto any mod website and be able to find their name in the credits just as a small token of appreciation for their code or their idea.

                            Ok there is no requirement for IW to add an acknowledgement into the game for these people however if you had devoted the past 2-3 years of your spare time to developing these ideas, giving the community something to play with while we loyally wait for the next incarnation of the CoD series. Would this not just come across as a big FU too?

                              EULAs mean ABSOLUTELY NOTHING in a court of law. IP and Copyright laws have time and time again been upheld over EULAs. EULAs are actually often in violation of other laws, but are never challenged. See:

                                Granted, Joker did put Nuke and AC130 into MP mod game, using tools and parts from original game. According to developers MW2 has been in development for last two years, how do we know that all of that wasn't planed from very beginning. I do believe that any work should be recognized, but raise this issue over this is dumb.
