A growing number of users are reporting that they have been banned by Microsoft from using Xbox Live. It appears as though most were banned after they discussed making "backup copies" of titles not yet released or just released to the public. Others stated that they were able to play unreleased games early, leading some to speculate that this talk meant that they pirated the game.
Naturally, a number of gamers are claiming complete innocence in this matter. Xbox Live's Major Nelson made a statement about the bannings spree earlier today.
Now, before everyone accuses all of those who were banned as being modders or pirates, you may want to have a look at this thread on the Xbox forums. There may have been a few innocents caught in the crossfire, just as this user was. He reported his two consoles as being banned two days ago. His systems are both now unbanned after he was the apparent victim of a wrongful ban.
Yes, it does appear as though Microsoft makes mistakes from time to time. However, this is a unique case and undoubtedly most of the other, legitimate bans will stick.
