I still find it amazing.
Something that's not almost purely black and white (like say driving too fast) can't be regulated by the juristiction of the police. Thus every such "grey" area enforcement would have to get court time.
The bulk of the nutty ideas of nutty lawmakers simiply don't make it trough the burocratic grinding machine because somebody along the way notices that it would anihilate any and all reasonable proceedings by clogging up courts beyond rescue.
A note to you, nutty lawmaker. If you can any way forsee that you're dealing with something that is so widespread practise it would be virtually impossible to enforce it judically, well, that's a clue you're just now thinking up a nutty idea. /wink /spankComment

What's a mod?
Weelll, pretty much anything is on some level a mod of something else. Most game programmers start out as traditional modders anyway, and then sorta shift up the ladder until they do higher level modding.Comment

You guys don't know what you are talking about.
The ESRB aren't trying to shut down modding.
The ESRB's problem is that the code, assets and animations for Hot Coffee was put in the game by Rockstar, and Rockstar knew it was only a matter of time before a coder 'unlocked' it.
When you submit a game for standards rating, you must disclose all parts of the game to them so they can assess it in its entirity. Rockstar didnt do that, they tried to slip this smut in under the radar and they got busted for it.
This has nothing to do with modding, its about Rockstar trying to subvert the rules and paying the price for getting caught.Comment

See Rockstar most likely didn't do that on purpose, as in "We're a kewl company and we put schmutz in our games and make it so the raters won't see it".
Most likely it's a dirty idea somebody had at one point, that maybe even got tried out, and then found the disaproval. Then either somebody simply forgot to thake it out for good, or the proposing programmer with a grudge that his idea was killed decided that he'll slip it in secretly. Q&A didn't look close enough at the checkins and you've the lametable situation.
Of course Rockstar is responsible, in the same way that parents are responsible for their Children.
I just wouldn't get so far as to accuse them of willing undermining of the Rating system because they felt like it.
Like most lamentable things that happen in the world, it's just a series of missunderstandings, errors, murphy and a bit of bad luck. Get over it, grow up. Your kids won't draw mental or physical dammage. Frikin americans, you're only happy if you can complain enough, cry and make a court-case out of every poop.
Me? I love it! Actually I bought the game only after this whole shebang went down. Congrats Rockstar for rocking the scene!Comment
