actually its copyright infringement to use entire versions of songs, only they haven't been caught. You can take your chances. I'm not sure if giving credit to original author lets you use it because you still need permission.
It is technically illegal to use any copyrighted material without licensing. However, to get into legal "trouble", you would have to make some sort of profit that the rights onwers could prove as "damages." In the case of community videos for video games, you are safe to use whatever you like unless you are selling it.
