Ask Activision, I can see that they offer replacements for damaged media, maybe they will sell you a new one even though the old one is completely lost:

Aslong as you have your serial then your ok, you could borrow the disk of a friend or something. But as you say you have lost that also. Best to contact Activision and see what they say/do.
All you need is the serial. Just download the game from a torrentsite and install with your own key.
I didn't want to be the first to suggest it, but this is my thought on the situation.
I had to do this with WinXP when I lived in the desert. A grain of sand got into my DVD drive and carved a trench in the disc, so I downloaded a copy and used my real product key. It hasn't caused me any problems with activation, since the key is the genuine one I bought.
You know it is legal to download the game and use the legit CDKey, its only illegal if you use a ******. You can just download the game via torrent and use your CDKey.
