It's not out of bounds. It could be that your SL is surrounded by other squaddies but I'm not certain.
Anyhow I think any hope of these bugs being fixed now are gone. For me the game works well enough 90% of the time and I suppose that is all you could hope for.
I actually always assumed it meant another Squad Member was spawning on him at that point as well so you have to wait until they pop before you can.
But does it work because it just does, or does it work because in the time it took you to select somewhere else and then the squad leader again, your SL moved into a spot that made enough room for you to spawn?
It takes me less than 5 seconds.

It happens in BF2 as well, Its when the SL is not in enough room. So many times the Sl has been a sniper and wedged in somewhere all you have to do is type, "can you move a little please" even strafing to the side a little will enable you to spawn.
