Seeing how the "spyware" on 2142 only takes your ip address and location and nothing more, I'm calling bs (much like anytime you join a bf2 server, it takes your ip and guid).

Companies like EA employ people to track who downloads their games on bit torrent, and other P2P platforms, so it is likely they know if you have, but unlikely they'd get you arrested. More realistic is that you'd get a letter from your ISP telling you to stop downloading copyrighted material or face the consequences, sort-of thing.
