I am going for my professional engineering license (civil) and then maybe i'll go to law school....i know what you mean about the amount of evil out there just lining their pockets at the expense of others...

Don't even let me get started on land rights....I live in New Jersey and you can't (well prolly can) imagine the rights that the government (in the hands of certain so called do-gooders) takes away...everyday there are new ordinances and legislation that take away ones land rights...well as they put it "oh we're not taking away your rights...we are still letting you build a house on your land..." except that the other 100 acres you own you can't touch (exept for the unlikely posibility you will get an exception at the cost of tens of thousands and a 3-5 year permitting period in which new laws are past that make you start all over again) can anyone say "highlands act"?

hehe anyways im thinkin i might go into helping people work the loop holes to be able to use their land and not have the state or municipality reduce their land values by the millions... ugh

The fact that the coffee was spilled is irrelivent. A liquid hot enough to cause 3rd degree burns served to a customer who is expecting to consume it is a friggen dangerous thing. If she had managed to take a good healthy swig, what do you think it would have done to the inside of her mouth?

Think about it.

Sounds like you are pre-law or in law school, so you know the laws and what-not about when it's ok to sue. If you take a good healthy swig of coffee anywhere right after you get it, it's going to burn your mouth. Now perhaps most places would not give you 3rd degree burns, but you'd still get burned.

Did she have the right to sue because of the severity of her burns? Yes, obviously she did since the courts allowed it.

However, just because you can sue doesn't mean you should. If you spill coffee on yourself, it's going to burn you (to some degree). Furthermore, just because there was no warning present doesn't mean that a hot beverage will not burn you (legally it's important, but if she had some common sense). If you drink coffee in a car, you are more likely to burn yourself. The biggest factor in her getting burnt, IMO, was her own stupidity and clumsiness. I agree that legally it's McDonald's fault. However, from a common-sense point of view, that woman is at fault. I don't care how hurt she got, the bottom line is she is the one that spilled the coffee. And I'll say it once again, I'm not arguing the law (I probably don't know enough to argue it with you anyway lol), just for people to use common sense and take responsibility for their own actions every once in a while.

I like it when people refer to the McDonalds case. You must not know a whole lot about the case.

The coffee was around 200F and caused 3rd degree burns....

than can we refer to the case where a man bought an RV, and put it on cruise control on the highway, so he could go take a shower, and the thing crashed. he ended up winning the lawsuit too.

Hehe, the number of times I've seen people bring up class action in the games industry...

I've even seen one filed.
None have ever gotten anywhere.

Thing is, there's this little clause in the EULA. "On-line game play my change". Broken = changed. However, the product you purchased still functions the same way it did when you purchased it (minus patches, it's still the same product that came out of the box). Thus, no case.

Not that I'd personally go through with it, even though I think the game has turned to ****. But what if the package doesn't function as advertised? There are some things that are missing from this game that were pumped into alot of the advertisements (laser designator, buddylist to name a couple etc)

So if I sold you a bottle of pop that contained hydrocloric acid and you accedently spilled it all over yourself, you wouldn't be mad enough to sue?

That is not the same thing as hot coffee. They didn't switch what was in there, it was just hot, the way you expect coffee to be.

I don't know about you, but when I order coffee, I assume it is hot and I don't clasp it with my crotch or knees while sitting in a vehicle (because it is hot). Common sense.

People like that make me wonder when someone is going to sue any soda company for cutting their lip on a can when they punch a hole in it where it says 'For best taste drink by date on bottom of can' then trying to consume it because they think it will taste better at that spot.

Not that any of this really matters, everyones opinion of what is common sense is different. So it's really a moot point and what's done is done.

For the guy that said she's rich, she isn't all that rich, she got alot of money, but I don't think it was in the millions after all was said in done after the initial court case:

The jury awarded Liebeck $200,000 in compensatory damages. This amount
was reduced to $160,000 because the jury found Liebeck 20 percent at
fault in the spill. The jury also awarded Liebeck $2.7 million in
punitive damages, which equals about two days of McDonalds' coffee
sales.

Post-verdict investigation found that the temperature of coffee at the
local Albuquerque McDonalds had dropped to 158 degrees fahrenheit.

The trial court subsequently reduced the punitive award to $480,000 --
or three times compensatory damages -- even though the judge called

Gatoraid (or Gatorade as it's maketed in the US) was designed as a highend nutrial replacement for ultra-active athletes who lose large amounts of salts and electrolites during strenious activity. The idea was to create a fluid that would absorb quickly and easily into the blood system to avoid the shock of depletion. The problem is that it's absorbed so quickly that it hammers your kidnies.

FYI, because of this, professional sports rejected the use of Gatoraid. You know those big coolers you see on football fields? They're full of water. Gatoraid pays the federations to put their name on the coolers despite the players not drinking it. Also, because it was rejected by pro-sports, the company had to find a new market. They turned to selling it to the masses because they are easy to sway, don't check their facts, and is much bigger anyway. "Make it look cool and people will kill themselves with it while handing you their money", is a popular unoffical motto for these guys.

Point is, I'm a big game fan, but I'm also into the real world. There's some truely evil crap going on these days. That's why I simply can't get bent out of shape over recreational activities that don't hurt anyone.

Man... I feel like ranting off about the abuse of the World Bank and the International Banker's Assosiation (some of who's members make more money in a day than Microsoft makes in a year... and it all comes right outta our pockets). I'll leave some of the world's evils for you folks to discover on your own, tho.
