Bioshock and my PC

I'm having trouble with Bioshock, for some reason the AI is buggy at times. For example, I will shoot an enemy or w.e. and the attacker will seem to float or lag to the ground even though I'm getting 70 FPS. Are any of you getting this?

Specs:
AMD Athlon 64 X2 6400+ 3.2ghz
2 gigs DDR2
EVGA 8800 GTS 320mb.

ive heard the physics engine is limited to 30 fps.
